OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF 100 dollars OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

Informal Resolution

Before filing a claim, you agree to contact us at info@mominglobal.com to attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If informal resolution fails, you agree that any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in Santa Clara County, California, unless otherwise agreed.

Class Action Waiver

YOU AND Momin Global Holdings AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS WIDE ARBITRATION.

Exceptions

Either party may seek injunctive or equitable relief in court to protect intellectual property rights or confidential information.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

To the extent arbitration does not apply, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Santa Clara County, California.
